Roles and Responsibilities 01

Phase I: Initial Phase of Project

  • Reading and analysis of the Contracts
  • Drafting Contract Appreciation Document (CAD), Contractual correspondence
  • Providing assistance to Project Team in initial contractual compliances required during Letter of Award (LOA) / Commencement stage and during Contract closure i.e.
  • Keeping a check on contractual-commercial obligations / financial closure (including guarantees and insurances related obligations) along with other obligations defined (of all the parties) under the Contract. Accordingly, preparing necessary contractual documentation and their requisite submission
  • Checking and implementing in respect of applicable acts and applicable permits or assist Contracts In-charge or project team (as the case maybe) in the same.

Phase II: During the execution of Project

  • Drafting of contractual correspondence and maintaining all the correspondence / documents in completeness both in hard and soft copy in co-ordination with the Document controller. Also, maintaining the documents tracker online (with access to both site and Head Office / Business Unit Contracts Teams).
  • Responding to client letters in time
  • Timely notifying intra and inter-department w.r.t. contractual requirements.
  • Assisting Contracts In-charge / Cluster head for cross functional coordination with Planning, Execution, Quantity Survey, QA/QC, Finance etc. and extending support to the Project and Execution Teams including contractual communications and compliances.
  • Monitoring Interim Payment Certificate (IPC) and assisting Quantity Survey / Project Manager / Contracts in charge / Cluster Head / Head Office Contracts (as the case maybe) in making proposals and thereby aiding in getting withheld amounts released.
  • Presenting (PPT) project specific issues affecting work schedule / cost to Head Office Contracts
  • Preparing Management Information System (MIS) contractual reports.
  • Assisting contracts auditor with periodical auditing.

Phase III

A.  Claim Management/ Change Order

  • Keeping a check on the scope of work versus execution and additional instructions (verbal or otherwise) from the Employer and / or Engineer. Preparing / assisting in preparation of notification based on the same which shall be shared inter-party in terms of the Contract.
  • Initiation the Change Orders / Change of Scope with the Employer and / or Engineer.
  • Keeping a track of change in applicable laws, change in scope/variation, price indices etc. and formulating the claims accordingly and submissions with complete justification.
  • Extension of Time (EOT): Raising time extension claims in every 6 months or as situation dictates, whichever is earlier. Ensuring that extension of time (EOT) is submitted with a proper delay analysis and impacted programme.
  • Preparation of contractual letters, claims, variations on all ongoing issues viz. land acquisition issues, charted and uncharted utilities, claim for extension of time, change in scope order/change orders, non BOQ works, new rates’ claim, delay damages, extended stay claims etc. Rate analysis wherever required to be prepared/assistance to be provided to the QS engineer/manager in this regard.
  • Insurance Claims: Maintaining insurance policies and timely initiate claims with concerned department/person in case of occurrence of related events and get it realized

Phase III

B.  Commercial & Procurement Management

  • Ensuring compliances and lodging / pursuing claims regarding procurement e.g., Custom Duty Reimbursement and import/export duty exemptions (wherever applicable) issuance of Letter of Credit (LC) etc. 
  • Keeping a check on requirements as per contract, drawings and also verification of quantities / items / cost claimed under monthly bills and securing / release of withheld amounts.
  • The ledgers, invoices, and proof of payment in all respects shall be properly maintained at site.

C.  Client Relationship

  • Accompanying Project Manager / Contracts in charge in attending contractual / commercial meetings with Client.
  • Preparing of weekly MOMs with the Client
  • Ensuring handing over/ taking over of documents is in line with the contractual terms.
  • Building positive relationship with the Client.

D.  Final Bill

Properly drafting the final bill (along with complete back up data for the claims and otherwise) assisting QS and in consultation with Contracts in Charge/ Cluster head and Head Office /Business Unit contracts.

Phase IV: Dispute Resolution 

  • Ensuring all the correspondence, request for information (RFIs), daily progress report (DPRs), monthly progress report (MPRs), project completion report (PCR), as built drawings, final bill, and other documents (in completeness with all enclosures) are placed at site in order (both in offline and online mode). Access provided to site and Head Office contracts executives.
  • Preparation of chronology of events – claim wise in a set format.
  • Preparing / compiling all documents under the guidance of Contracts In charge / Cluster head and / or Head Office / Business Unit contracts for initiating Dispute Resolution Procedure outlined in the Contract viz. Conciliation, Dispute Resolution Board (DRB) proceedings
  • Providing support for the arbitration process in collaboration with and under the guidance of Head Office – Contracts Team.

Key Objective of the Job Position

To ensure that the Client, Contractor, and other stakeholders perform in accordance with all the terms and conditions of the contractual agreement, manage contractual disputes, provide contractual updates to the site and HO (PM and HO Contracts), and analyze and mitigate contractual risks for effective project performance.

Education Qualifications

Educational Essential: Bachelor’s Degree in Civil Engineering

Educational Desirable: Masters or PGDM in Construction Management or Civil Engineering

Computer Software Proficiency

MS Excel, MS Word, Power Point,

Experience Range

For Manager: 12+ Years of Experience out of which minimum 5 years’ experience as Contracts Engineer under Contracts domain
For Sr. Engineer: 7 - 11 years’ experience out of which minimum 3 years’ experience as Contracts Engineer under Contracts domain
For Engineer: 1-6 Years experience
and should have dealt with business units viz. Surface Transport / Urban Infra / Underground Metro / Elevated Metro / Hydro Tunnel / Marine - Jetty Projects / Oil and Gas. Have a good understanding of Contract forms like NITI Aayog / FIDIC (Red and Silver books) / Railways / Oil & Gas / NHAI project conditions.

Work Environment

At site office with regular site visits. Maybe required to work on computer for long hours. Collaborative work: inter department and with HO team. Should be able to manage stress well. Occasionally may need to work extra hours to ensure that deadlines are met. To be able to communicate, negotiate and persuade. Need to work closely with Contracts In-charge/Cluster Head, HO Contracts and Project Manager.
